MIAMI, FLORIDA — September 16, 2026 — Lydecker LLP Partner Michelle Diverio, Esq., secured an order from Florida’s Third District Court of Appeal awarding appellate attorney’s fees to her client while defeating a competing fee request from the opposing party.
The order arose from an appeal stemming from litigation in Miami Dade County. On June 18, 2026, the Third District granted Lydecker’s client’s motion for appellate attorney’s fees and remanded the matter to the trial court on the condition that the client establish entitlement under Florida’s offer-of-judgment statute and rule. In the same order, the court denied the opposing party’s motion seeking appellate fees.
The panel – Chief Judge Scales and Judges Logue and Gordo – concurred in the ruling, which followed the firm’s successful appellate defense of its client’s position.
Diverio’s continued work on the fee dispute reflects the firm’s effort to fully vindicate its client’s position, including recovery of the fees and costs incurred throughout the appeal.
