MIAMI, FLORIDA – September 14, 2026 – Lydecker Partner Paola Garcia, Esq., and Associate Andres Hidalgo, Esq., secured the dismissal of claims and summary judgment in favor of their client in a case filed in Florida’s Twentieth Judicial Circuit.
The dispute arose after the plaintiff’s membership in the club was terminated due to alleged violations of its membership guidelines. Following the termination, the plaintiff filed an initial lawsuit in December 2022 alleging breach of contract, declaratory judgment, breach of the implied covenant of good faith and fair dealing, and constructive fraud.
The first lawsuit was litigated for approximately two years and seven months before two different judges. On the eve of trial, July 7, 2025, the plaintiff filed a Notice of Voluntary Dismissal Without Prejudice pursuant to Florida Rule of Civil Procedure 1.420, thereby dismissing the first lawsuit.
Two months later, the plaintiff filed a second lawsuit arising from the membership dispute. After approximately one year of litigation, the court granted the defendant’s Motion to Dismiss and entered summary judgment as to the claims asserted against Lydecker’s client.
Because the plaintiff did not accept a Proposal for Settlement, the defense is also entitled to seek recovery of its reasonable attorney’s fees and costs.
Garcia and Hidalgo worked collaboratively to develop and present the successful defense strategy throughout the litigation.
