Lydecker LLP Prevails in $3 Million Construction Defect Trial

[Miami, Florida] — [November 10, 2025] — Lydecker LLP, a national litigation firm, proudly announces a significant legal victory in the Del Webb Orlando HOA, Inc. v. J.L. Land Developer, Inc., in Polk County, Florida, where Lydecker LLP’s Construction Practice Chair Spencer Mallard successfully represented the firm’s client in a construction defect trial where a homeowners’ association alleged over $3 million in damages to replace all roadways in a large community.

After the presentation of testimony, evidence and argument on all liability and damages issues over 4 days, the Court determined that the firm’s client was entitled to a complete judgment in its favor based on the expiration of the applicable 10-year statute of repose. In response to a heavily disputed set of factual and legal issues, the Court found that the client was a prior owner of land in the subject community whose ownership interest ended over 10 years prior to the association’s filing of suit. The Court also found in favor of the client on multiple legal issues pertaining to the interpretation of the statute of repose in the context of a multi-phase construction process.

“It is always a challenge to prevail under the older versions of Florida’s statute of repose and it is gratifying that were able to win this case with such complex facts surrounding a company that is no longer in existence with no surviving employees,” said Spencer Mallard, who led the trial team. “Fortunately, we were able to present the documents and testimony in a way that allowed the Court to get to the correct decision.”
