MIAMI, FLORIDA — September 16, 2026 — Lydecker LLP Partner Michelle Diverio, Esq., secured a full affirmance from Florida’s Second District Court of Appeal in favor of their client in a property insurance dispute originating in the County Court for Hillsborough County.
The appeal arose after a service provider, individually and as assignee of a policyholder, challenged a ruling entered in Lydecker’s client’s favor. The appellee argued that Fla. Stat. 627.7152(2)(c) limits an assignee’s recovery when services are provided under emergency circumstances. The appellant failed to meet its burden of establishing that the services were not emergency related.
On June 19, 2026, a three judge panel consisting of Judges Silberman, Kelly, and Rothstein Youakim issued a per curiam decision affirming the trial court’s ruling in full and closing out the appeal in Lydecker’s client’s favor.
Diverio also obtained a favorable ruling concerning appellate attorney’s fees and costs on behalf of her client.
