Middle District of Florida Grants Motion to Dismiss Plaintiff’s Amended Complaint
MIAMI, FLORIDA – September 3, 2026 – Lydecker Partner Yina Cabrera, Esq., and Associate Andres Hidalgo, Esq., secured the dismissal with prejudice of a federal civil action involving allegations concerning the death of an inmate.
The lawsuit was brought by the decedent’s estate, which alleged that the actions of correctional officers contributed to the inmate’s death. Lydecker filed a Motion to Dismiss the Plaintiff’s Amended Complaint on behalf of its clients.
On August 27, the United States District Court for the Middle District of Florida entered an Order granting Lydecker’s Motion to Dismiss the Plaintiff’s Amended Complaint with prejudice. The ruling prevents the plaintiff from filing another amended complaint asserting the dismissed claims.
Cabrera and Hidalgo worked collaboratively to develop and present the successful defense strategy, resulting in the dismissal of the action.
